The President and the Secretary of the Supreme Court Bar Association (SCBA) have requested Chief Justice Syed Mahmud Hossain to start the court activities across the country in a limited scale through special arrangements to protect the fundamental rights of the citizens.
“The Chief Justice told me that he would soon discuss the matter with other judges of the Appellate Division and then he would take a dicision,” said SCBA President Advocate AM Amin Uddin, who requested over phone on Monday.
SCBA Secretary Barrister Ruhul Quddus Kazal also requested the Chief Justice to open the court activities
in a limited scale over phone on Sunday. The whole country is on lockdown as part of fighting novel coronavirus. In this circumstance, activities of all the courts, including the Appellate Division and the High Court Division of the Supreme Court, have already been suspended from March 24 as a precautionary measure to combat the infection of virus Covid-19.
The closure of the courts till April 25 might be extended considering the situation, sources said.
Advocate Amin Uddin said, “Many litigants are facing problems as the apex court is totally closed. If someone doesn’t get remedy in a magistrate court, then he has the right to go to the higher judiciary. But it is not possible now.”
“I requested the Chief Justice to open the window at least for justice,” said the SCBA President.
Barrister Ruhul Quddus Kazal said, “This is unfortunate that an important organ of the state is totally dysfunctional. I think Constitutional vacuum has been created as the Supreme Court is closed.”
“We, the lawtyers, will appear in the court maintaining social distancing if the courts are declared open,” added the SCBA Secretary.
