SC upholds Justice Zainul’s bail

The Appellate Division of the Supreme Court on Monday upheld the anticipatory bail of former Appellate Division judge Justice Md Zainul Abedin. A 3-member bench of Appellate Division led by Justice M Abdul Wahhab Mia passed the order yesterday.
Earlier, on July 10, the High Court Division granted the anticipatory bail to retired Justice Zainul Abedin in connection with an Anti-Corruption Commission (ACC) notice after he filed a petition seeking the bail fearing that he might be arrested when he would go to submit the bank statements.
The ACC issued the notice on July 18, 2010 seeking the retired judge’s bank statements. Later, on July 25 of the year, the former judge
filed a writ petition challenging the notice, however, the writ petition was rejected as it was not moved. Although, on October 25, the ACC sent a notice to the retired judge asking his statement of assets, the matter did not proceed further.
Later, in last January, the ACC asked Justice Zainul Abedin to appear before them in connection with the previous statements of assets. They also sent a letter to the Supreme Court on March 2 seeking necessary papers of the judge. However, the apex court sent a letter to the ACC asking them not to make any inquiry into the matter.
On Monday, Barrister Mainul Hosein moved the case on behalf of Justice Zainul Abedin, while advocate Khurshid Alam Khan appeared in the court on behalf of the ACC.
