SC upholds HC order on Brazilian wheat

The Appellate Division of the Supreme Court on Thursday upheld the High Court’s order that the government can’t force anyone to accept the substandard Brazilian wheat if any department wants to return the grains.
A four-member bench of the Appellate Division headed by Chief Justice SK Sinha passed the order after rejecting a leave-to-appeal petition filed by the government challenging the High Court’s order.
Attorney General Mahbubey Alam represented the state, while Advocate Joynul Abedin stood for the petitioner.
After order of the apex court, Mahbubey Alam said that the government could now distribute the remaining wheat to any organisation if it was willing to take it.
The High Court issued its order on July 8 upon a writ petition filed by Pavel Miah, a lawyer, on June 29 seeking the court’s directives to investigate the allegation of rotten wheat imported from Brazil.
The HC considering the imported wheat unfit for consumption issued a rule asking the authorities of the Directorate General of Food to explain within 72 hours whether the wheat imported from Brazil was fit for human consumption. Later, the HC gave its order. It also ordered the authorities concerned to take back the wheat if anyone was willing to return it distributed earlier among the police, BGB, Ansar, prison, dealers
