Aug 21 grenade attack: SC upholds bail of two ex-IGPs

The Supreme Court (SC) on Wednesday upheld a High Court order that granted anticipatory bail to two former Inspectors General of Police (IGP), Shahudul Haque and Asharaful Huda, for six months in August 21 grenade attack case.
Chamber Judge Md Nuruzzaman passed “no order” on the government’s appeal filed against their bail granted by the HC.
Advocate Md Arshadur Rauf, a lawyer for Shahudul Haque and Asharaful Huda, said that the Supreme Court’s “no order” means that the High Court order will remain in force. So, now there is no legal bar on their release from jail, the lawyer added.
On January 21, 2019, the High Court bench of Justice Sheikh Abdul Awal and Justice Bhishmadev Chakrabortty granted anticipatory bail to two former Inspectors General of Police for six months in August 21 grenade attack case after admitting their appeals against lower court verdicts.
The government appealed against the bail order which was heard yesterday.
Advocate Md Arshadur Rauf appeared in the court on behalf of the two former IGPs, while Attorney General Mahbubey Alam and  
Deputy Attorney General Masud Hassan Chowdhury stood for the State.
Advocate Md Arshadur Rauf said, “The charge brought against the two IGPs is bailable. They were awarded two years imprisonment in the case. But they have already served 14 months during the trial. Considering this, the HC granted them anticipatory bail for six months. At the same time, the HC stayed the payment of the penalty of Tk 50 thousand each by the IGPs. Now the HC order will remain in force as the SC passed no order.”
Attorney General Mahbubey Alam said, “We will file regular leave to appeal petition after getting the original copy of the HC order.”
A Special Court in Dhaka on October 10 last year sentenced the two former IGPs for two years imprisonment and penalty of Tk 50 thousand for each. The court also ordered them to serve six months in jail in case of failing to pay the penalty.
The Special Court sentenced 19 persons including former State Minister and BNP leader Lutfozzaman Babar to death and 19 others including BNP’s Acting Chairman Tarique Rahman life imprisonment in connection with the August 21 grenade attack case.
At least 24 people were killed and around 300 injured in the grisly attack on an Awami League rally in the capital’s Bangabandhu Avenue on August 21, 2004.
Sheikh Hasina, the then opposition leader in the Parliament, narrowly escaped the attack with an ear injury.
The grenade attack is one of the most shocking political crimes in the country’s history.
Two cases were filed against 49 people with Motijheel Police Station, one for murder and another under the Explosive Substances Act.
