The Supreme Court (SC) on Tuesday upheld a High Court (HC) order that granted bail to suspended Sylhet City Corporation Mayor Ariful Haque Chowdhury and Habiganj Municipality Mayor Golam Kibria Gaus in two separate cases.
A four-member bench of the Appellate Division of the SC headed by the Chief Justice Surendra Kumar Sinha passed the order dismissing two separate petitions filed by the government seeking a stay on the HC order.
The lawyers of the two Mayors said there was no legal bar then for them to get released from jail after the apex court order.
Senior Advocate Khandker Mahbub Hossain represented Golam Kibria Gaus and Barrister Mainul Hosein represented Ariful Haque Chowdhury in the court, while Additional Attorney General Momtazuddin Fakir stood for the State.
On December 11 in 2016, the High Court granted bail to Ariful, also a BNP leader, and Gaus in response to separate bail petitions filed by them in two cases filed under the Explosive Substances Act, 1908.
The case against Ariful was filed following an incident of bomb blast at a public gathering in Sunamganj’s Dirai Bazaar on June 2004 that left a Juba League activist dead and 29 others injured.
Gaus is an accused in another case filed in connection with the murder of former Finance Minister Shah A M S Kibria. Five people, including Kibria, were killed and 70 others injured in a grenade attack into a public rally of local Awami League at Baidder Bazar of Sadar upazila in Habiganj district on January 27, 2005.
Two cases, one for killing and another for blasting bombs, were filed in this regard.
