SC upheld HC order allowing Barrister Mainul to go abroad

The Appellate Division of the Supreme Court on Monday upheld a High Court order that directed the government to allow Barrister Mainul Hosein, an Advisor to the former Caretaker Government, on going to Bangkok for medical checkup.
A four-member bench of the Appellate Division headed by Chief Justice Syed Mahmud Hossain passed the order after hearing a petition filed by the government seeking stay on the High Court order.
After the court order, Barrister Mainul Hosein said, “It was absurd for the government to challenge such an order of the High Court division.”
The High Court on Mach 4, 2019, directed the government to allow Barrister Mainul Hosein to go to Bangkok for checkup. It also issued a rule asking the government to explain in four weeks as to why barring Mainul at the Dhaka airport on February 23 from leaving for Bangkok should not be declared illegal.
The HC bench of Justice Tariq-ul Hakim and Justice Md Shohrowardi passed the order and issued the rule after hearing a writ petition filed by Mainul Hosein.
In the petition, he sought court order for allowing him to go to Bangkok on March 9, saying he would return after the checkup.
Advocate Khandker Mahbub Hossain appeared in the court on behalf of Barrister Mainul Hosein, while Attorney General Mahbubey Alam stood for the state.
In the hearing, Advocate Khandker Mahbub Hossain said, it is an fundamental right for one to go abroad and to come back to the country as per our Constitution.
“To harass the leaders of the opposition political corners has become a routine work for the authorities of the Hazrat Shahjalal International Airport. Through this, the honorable citizens of the country are being dishonored. It should be stopped,” argued the counselor.
