Chief Justice SK Sinha on Sunday said the Supreme Court will not backtrack from scrapping any provision of the Constitution or any law if its formulated violating people’s rights.
“Even if the 300 MPs enact any anti-Constitution law or bring any amendment which is contrary to the Constitution, those will be annulled too. It’s the Constitution which gives the Supreme Court this power,” he said.
The Chief Justice was speaking as the chief guest at a function at Jagannath University in the city.
By dint of this power bestowed upon it by the national charter framed by Bangabandhu Sheikh Mujibur Rahman to make judicial review of any law, SK Sinha said, the apex court had earlier scrapped the 5th, 7th, 8th and 13th amendments to the Constitution.
About Prime Minister Sheikh Hasina’s reiteration that the three organs of the state-legislature, judiciary and executive-will have to work with an understanding for successfully running the state, he said he himself also wants this.
Mentioning that judges teach legal aspects at universities in different countries, the Chief Justice said, “Their speeches are not published in newspapers but that of your Chief Justice hit headlines. This is because we couldn’t reach that level and that we couldn’t establish the rule of law.”
SK Sinha also urged the country’s people not to react to the explanations given by the apex court to establish the rule of law.
Earlier, the Chief Justice inaugurated the Land Law and Management Department of Jagannath University.
