The Supreme Court (SC) on Thursday summoned two Secretaries of the Law Ministry to appear in the court on December 12 for not complying with its order about formulating the rules determining the guidelines of lower court judges.
The apex court asked Attorney General Mahbubey Alam to ensure the presence of Secretaries- A S S M Zahirul Haque and Md Shahidul Haque in the court in the morning of December 12 for giving their explanations.
The full bench of the Appellate Division headed by Chief Justice Surendra Kumar Sinha passed the order during hearing the Masdar Hossain case known as judiciary separation case.
Earlier, the SC ordered the Law Ministry several times to finalise the rules determining the guidelines of the lower court judges as per its directives. But the Ministry wanted more time from the Supreme Court for complying with the order.
On December 1, the Appellate Division set a time limit for seven days for the Ministry to finalise the rules and asked it to submit the gazette notification in this respect to the court on Thursday. But Attorney General Mahbubey Alam yesterday prayed to the apex court for further time on behalf of the Ministry.
Attorney General Mahbubey Alam told the reporters that he sought time for another two weeks as the matter was under process. But the SC summoned the two Secretaries in the court.
Appellate Division gave 12 directives in the verdict of Masdar Hossain case. To formulate the rules determining the guidelines of lower court judges was among those directives. The Law Ministry sent a draft rules on May 7 last year to the SC, which amended that draft but the Ministry didn’t publish a gazette yet.
