The Supreme Court in an order on Tuesday stayed the process of holding Tangail-4 by-polls till May 3.
Following the order, the polls slated for March 20 will not be held. A five-member bench of the Appellate Division, headed by Chief Justice SK Sinha, passed the order on a leave-to-appeal petition filed by Krishak Sramik Janata League president Abdul Kader Siddique against a High Court verdict rejecting his plea for permission to participate in the election.
The apex court also granted his leave-to-appeal
petition and permitted him to appeal against the HC verdict.
Attorney General Mahbubey Alam represented the state, while Advocate AJ Mohammad Ali and Barrister Ragib Rauf Chowdhury stood for Kader Siddique. Earlier on Monday, the bench fixed yesterday (March 15) for its order on the petition on completion of the hearing.
On February 25, Krishak Sramik Janata League president Kader Siddique filed the leave-to-appeal petition with the Supreme Court. After the resignation of Awami League MP of Tangail-4 Abdul Latif Siddique on September 1, 2015, the Election Commission fixed November 10 for holding the by-polls. After a scrutiny, the returning officer on October 13 cancelled the nomination paper of Kader Siddique on loan default charges.
The Krishak Sramik Janata League leader appealed with the Election Commission against the decision, but the commission rejected his plea on October 18. Later, he filed a writ petition with the High Court against the Commission’s decision.
Following this, the HC directed the Commission on October 21 to accept his candidacy and asked it and the government to explain why cancellation of his candidature should not be declared illegal. Following a government’s petition against the HC order, the Appellate Division on October 27 stayed the election until November 2.
