SC restores rights of Mohiuddin Chy over management of Premier University

Chittagong City Corporation again to face legal challenge over the management of Premier University following the final verdict of the Supreme Court Appellate Division over the management of Premier University .
 Full bench of the Supreme Court of Bangladesh in final hearing on Civil Petition for Leave to Appeal (CP No.3749/2015) on Thursday uphold the verdict of High Divison so delivered on December 10 last following the writ petition of former Mayor Mohiuddin Chowdhury and the HC division issued Rule Nishi in favour of the writ petitioner Mohiuddin Chowdhry. Following the HC verdict and chamber judge order in favour of Mohiudin Chowdhury, CCC filed leave to Appeal before the Supreme court Appellate Division later which finally heard on Thursday, a counsel of Mohiuddin chowdhury said.
A reliable sources said promoter and founder of Premier University Mohiuddin chowdhury will discharge official functions everyday at University campus . Legal advisors of PU founder told this correspondent that the claim of CCC for funding of Tk.5 crores for constituting preliminary fund of the university which could not prove before the higher court by CCC .
 In fact , Mohiuddin Chowdhury took loan of Tk.5 cr from S. Alam Group of chittagong for initial fund of the university. Senior advocate of SC Prabir Neogi and Amin Uddin duly assisted by Barrister Subra Chakraborty, Barrister Mohibul Hasan chowdhury, Barrister Anita Gazi Rahman and Advocate Manzur Matin defended the Mohiuddin chowdhury. The counsels of Mohiuddin Chowdhury further told that a trusty board consists of old trusty members will be constituted soon .
 Mentionable that High court issued Rule Nishi to Chittagong City Corporation why the involvement and intervention to the affairs of PU will not be declared illegal . Pending the finalization of the HC rule , the promoter of the PU and former Mayor ABM Mohiuddin should not be resisted from participating any participation of the activities of this private university , HC rule said. HC also asked the CCC to clarify reasons why ABM MohiuddinChowdhury will not be allowed to form Trusty Board. Following the rule of higher court of Bangladesh, founder of PU and former Mayor ABM Mohiuddin chowdhury gets back the authority of running the PU again. Meanwhile after sworn of AJM Nasiruddin as city Mayor , a vested quarters tried to keep away Mohiuddin Chowdhury from any major activities of the university . But after taking shelter of law, Mohiuddin chowdhury thrown the CCC into challenge over the authority of PU.
A sources of former Mayor Mohiuddin chowdhury said promoter of the PU Mohiuddin Chowdhury filed a writ petition before the High Court divison on December 9 last(petition No.12892/2015) and the hearing over the WP held in the bench of Justice Saima Haider and Justice Mostafa Zaman Islam . In the WP hearing , the counsel of the petitioner Advocate Pravir Neogi presented the background of PU, role of Mohiuddin Chowdhury as prime promoter, rules of private university act and UGC role on private university before the bench and after end of hearing, learned High court issued Rule Nishi to CCC . Another counsel of the writ petitioner Barrister Mohibul Hasan Chowdhury told this correspondent that under the act of Private University ordinance, PU is established in 2002 and the prime promoter of this PU was ABM Mohiuddin Chowdhry.
Though the PU is a private university, CCC has no right to run this university because CCC is a public body and the govt sector is not allowed to run a private university . And hence under the rules of UGC, CCC has no right to claim ownership of this private university and no legal rights to interfere the matters of PU further. He further said PU is using the land of CCC and in exchange of that, PU is paying power bill, water bill and premise rent to CCC but in running the PU , CCC has no legal rights to interfere the matter of the private university. According existing laws of the land, PU is an independent private institution.
