SC rejects Mosharraf’s plea seeking stay on graft case

The Supreme Court (SC) on Sunday upheld a High Court order that cleared the way for a trial court to continue proceedings of a case filed against BNP leader Khandaker Mosharraf Hossain by Anti-Corruption Commission (ACC).
The four-member Bench of the Appellate Division headed by Chief Justice Syed Mahmud Hossain dismissed a leave to appeal petition filed by Khandaker Mosharraf challenging the High Court order that rejected a

petition filed by Mosharraf seeking further investigation and a stay order on trial proceedings.
Earlier on January 9 this year, the HC Bench of Justice M Enayetur Rahim and Justice Shahidul Karim rejected Khandaker Mosharraf Hossain’s petition seeking further investigation and a stay order on trial proceedings.
Advocate A J Mohammad Ali appeared for the BNP leader while Advocate Khurshid Alam Khan stood for the ACC.
The Anti-Corruption Commission on January 10, 2008 filed the case with Ramna Police Station against Khandker Mosharraf Hossain and his wife Bilkis Hossain on charges of amassing illegal wealth worth Tk 12.51 crore and concealing information about Tk 3.11 crore in their wealth statement.
Advocate Khurshid Alam Khan told journalists, now there is no legal bar for the lower court to continue the trial proceedings against Khandaker Mosharraf following the SC order.
Mosharraf said in his petition that he does not have the ownership of some properties mentioned in the case in which allegation were brought against him.
Later on Mosharraf filed the leave to appeal petition with the Supreme Court challenging the High Court order.
