The Supreme Court has fixed Thursday to pass an order in response to an appeal of Citycell, Bangladesh’s oldest mobile phone operator, against the cancellation of its operation.
The four-member bench of the Appellate Division headed by Chief Justice Surendra Kumar Sinha set the date on Tuesday after holding hearing on the petition.
On October 20, Bangladesh Telecommunication Regulatory Commission (BTRC) suspended the spectrum of Citycell as it failed to pay the outstanding dues of Tk 477.63 crore. This suspension brings Citycell operation to close.
After this decision Citycell filed the appeal petition on October 24 seeking injunction on the decision of BTRC canceling the allocation of the spectrum.
Chamber Judge of the Appellate Division on October 25 sent the petition to the regular bench for hearing. The four-member bench of the Appellate Division headed by Chief Justice heard the petition on Tuesday and set the date to pass an order.
Barrister Rokanuddin Mahmud represented Citycell in the court while Attorney General Mahbubey Alam stood for the state. Sheikh Fazle Noor Taposh pleaded for the BTRC.
Sheikh Fazle Noor Taposh told journalists that the BTRC was directed to tell SC in the next date what would be the solution if dispute seen between the two sides over the payment.
On August 29, the Appellate Division ordered Citycell to pay its Tk 477.51 crore dues to BTRC in two installments to continue its operation.
The apex court had asked the mobile phone operator to pay the first slot of Tk 318.42 crore, two-thirds of the total outstanding payment, within October 19.
As Citycell failed to pay the two-thirds of the total amount within the stipulated time, the BTRC took the decision to suspend the operations of the mobile phone operator as per the law.
