SC fixes Aug 26 for holding Bar Council polls

The top court has deferred the polls for Bar Council, which was scheduled for Aug 13.
An appeals bench led by Chief Justice Surenrda Kumar Sinha has set August 26 for holding the election for the lawyers’ regulatory body.
It also set July 30 for the deadline to publish the final electoral roll and August 3
for resolving any dispute over the voters’ list. Thursday’s order also ordered voters to carry their national identity cards or passport while exercising their franchise in the Bar Council polls.
On May 28, the court told the council’s chairman (attorney general) and secretary to review the voters list and publish the updated list by July 12.
Then it fixed August 13 for the polls.
On Thursday, Attorney General Mahbubey Alam pleaded to the court for more time when the Appellate Division deferred the polls.
The schedule for the Bar Council election was announced on Mar 25 setting May 20 for voting and an initial electoral roll comprising 48,465 voters was published on April 9.
Five elected members of the council and another 101 lawyers wrote to the chairman and the secretary, claiming the voters’ list was ‘vague’ and had repetition of names.
Following the objections, a Bar Council meeting on May 12 set May 27 for holding the election.
On May 21, the High Court stopped the election following petitions saying that the rules stipulate the publication of the final voters’ list 30 days before the polls, but that was not complied with in this case.
The Bar Council secretary and three candidates for the polls AJ Mohammad Ali, Mahbub Uddin Khokon and M Bodruduzza moved the appeals court to stay the High Court order.
Meanwhile, former Bar Council vice president Rokon Uddin Mahmud, who is also running for member in the upcoming polls, filed a petition for a faultless electoral roll.
Two Bar Council Committee members Syed Rezaur Rahman and HR Jahid Anwar also filed similar pleas with the court.
On May 28, the Appellate Division heard the petitions before setting Aug 13 for the voting, which was shifted to Aug 26 on Thursday after the attorney general pleaded for more time to publish the voters’ list.
The Bar Council polls elect 14 members. Of them, seven are elected through votes of registered lawyers and each of the rest by the seven regional Bar Councils across the country.
These 14 members vote to elect a vice-chairman. The attorney general acts as the Bar Council’s chairman as per the regulations.
