SC ditches HC acquittal of Huda, wife

The Supreme Court on Monday trashed a High Court order that had acquitted former Communications Minister Nazmul Huda and his wife Sigma Huda of bribery charges.
It also asked the High Court to rehear two appeals filed by the couple against the lower court judgement.
A four-member Appellate Division bench of the Supreme Court, headed by Justice SK Sinha, passed the order disposing of appeals filed by the Anti Corruption Commission (ACC) and the state.
On March 21, 2007, the ACC filed a case with Dhanmondi Police Station against Nazul Huda and his wife on charge of taking
 Tk 3.40 crore in bribe from a contracting firm. According to the case statement, Nazmul Huda took the amount from managing director of ‘Aktar Hossain Limited’ Mir Zahir Hossain promising to award him contracts.
On August 26 of the same year, a special court of Dhaka sentenced the former minister to five years’ imprisonment while Sigma Huda to three years. The court also fined Nazmul Huda Tk 2.5 crore.
Following two appeals filed by the couple, the High Court on March 20, 2011, cleared them of the bribery charges.
Later, the ACC and the state moved the Supreme Court against the acquittal.
ACC lawyer Khurshid Alam Khan said the Appellate Division asked the High Court to hear the two petitions of the couple again.
He, however, said they need not secure bail afresh as they were on bail before the High Court order.
