Staff Reporter :
Former Minister Barrister Nazmul Huda has to surrender in the lower court in a bribery case as the Supreme Court on Sunday rejected his petition to file an appeal against the High Court judgement.
A five-member bench of the Appellate Division headed by the Acting Chief Justice Md Abdul Wahhab
Miah passed the order as he did not first surrender to the lower court. The Anti-Corruption Commission’s lawyer Advocate Khurshid Alam Khan told the journalists that Huda must surrender to the trial court in the bribery case involving Tk 2.4 crore following the Supreme Court order.
The High Court on November 8 commuted the jail term of former BNP Minister Nazmul Huda to four years from seven years in the case filed during the regime of the military backed caretaker government, the lawyer said.
The court also directed Nazmul Huda to surrender in the trial court within 45 days after the trial court received the copy of verdict. But the High Court is yet to release the full text of the order, he added.
ACC’s Deputy Director Md Shariful Islam filed the case on March 21 in 2007 with the Dhanmondi Police Station. It was said in the case that Nazmul Huda and his wife Sigma Huda took TK 2.4 crore from Mir Zaher Hossain, owner of a leading construction firm, as bribe. The amount was deposited in the Sigma Huda’s bank account.
A Special Court of Dhaka delivered the judgement on August 27, 2007 in this case.
A High Court bench acquitted Nazmul Huda and Sigma Huda on March 20 in 2011 after hearing their appeal petitions. Appellate Division on December 01 in 2014 cancelled the judgement of the HC after hearing the appeal petitions by ACC and the government and sent the case back to the HC for further hearing.
