SC asks for fresh medical report on Fakhrul

Staff Reporter :The Appellate Division of the Supreme Court has once again ordered the government to arrange medical check-up for BNP acting Secretary General Mirza Fakhrul Islam Alamgir. The apex court also fixed July 13 for passing order on the government’s petition against a High Court order granting bail to the BNP leader. The court will pass the order in three separate cases after getting fresh medical report from the Bangabandhu Sheikh Mujib Medical University (BSMMU) authorities, as the court has asked the BSMMU authorities to form a five-member medical board to examine the health of Mirza Fakhrul.A four-member bench of the Appellate Division, headed by Chief Justice Surendra Kumar Sinha, on Thursday fixed the date and issued the order of forming the fresh medical board.The bench directed the BSMMU authorities to form the medical board with two surgeons of vascular surgery department, a respiratory medicine specialist, a medicine specialist and a cardiologist. It also directed to submit the report of Mirza Fakhrul’s physical condition by 3:00 PM on July 12. The apex court gave the order, as Mirza Fakhrul’s lawyers raised question about the report submitted on Wednesday by a four-member medical board of the BSMMU authorities in compliance with the SC’s July 5 order. Advocate Khandker Mahbub Hossain, lawyer of Mirza Fakhrul, told the court that the BSMMU authorities submitted the medical report, saying that he has been suffering from neck pain, where as, the BNP leader has been suffering mainly from cardiovascular problem.Ragib Rouf Chowdhury, another lawyer of Mirza Fakhrul, said as there had been cardiology reports only so far and the vascular surgery reports were yet to reach then, the court again ordered the BSMMU authorities to submit the remaining reports through the five-member medical board.On July 5, the bench fixed July 8 (Wednesday) for passing the order. But it didn’t do it for not getting the medical report by then. The report of the BNP leader reached the court in the afternoon on Wednesday. On June 28, the Appellate Division turned down the government’s petition against the HC’s order for bail granted on June 18 in the three cases filed on charges of violence. Two of the cases were filed with Paltan Police Station while another with Motijheel Police Station. Mirza Fakhrul is now facing 79 cases. He was admitted to the BSMMU on June 13 following a HC order. On January 6, police arrested him when he was coming out of the National Press Club.
