The Appellate Division of the Supreme Court on Thursday expressed dissatisfaction over a HC bench as it delivered an ‘unusual order’.
A seven-member bench of the Appellate Division headed by Chief Justice Syed Mahmud Hossain was hearing a civil case yesterday. At that time, Attorney General Mahbubey Alam prayed to the SC to take initiatives against the ‘unusual order’ delivered by a HC bench by sending the case to the President Md Abdul Hamid.
Then the SC disposed of the case with observations. The Appellate Division had been aggrieved with that ‘unusual order’ of the HC bench. Besides, the court fined the defendant Tk one crore.
The Appellate Division mentioned the incident, which happened with a verdict of that HC bench, as illegal.
Advocate Abdul Baset Majumder and Barrister Rokanuiddin Mahmud were the lawyers of the case of National Bank Limited
and others verses M R Trading Company and others.
Former Attorney General A F Hassan Ariff and Senior Advocate Khandker Mahbub Hossain also gave opinion during the hearing of the case.
After the court order, Advocate A F Hassan Ariff said, “Attorney General prayed to the SC to take initiatives against the ‘unusual order’ delivered by a HC bench by sending the matter to the President Md Abdul Hamid. Two other former Attorneys General (Advocate A J Mohammad Ali and Barrister Fida M Kamal) and Me and the SCBA President supported it.”
“The court (Appellate Division) was aggrieved with this matter. The dignity of the court is depressed by such unusual (preposterous) order. We prayed to the court to take action by sending the matter to the President or by other ways the court thinks fit for it,” the lawyer said.
