The High Court Division of the Supreme Court on Tuesday issued Rule upon the Government as to why the contractual appointment of Law and Justice Division Secretary Abu Saleh Sheikh Md Zahirul Haque should not be declared illegal. At the same time the court also wanted to know why the acceptance of his joining report shall not be considered illegal.
The High Court bench of Justice Syed Mohammad Dastagir Husain and Justice Md Ataur Rahman Khan issued the rule after a primary hearing on a writ petition. The court fixed Thursday for hearing on the Rule.
Cabinet Secretary, Public Administration Secretary, Finance Secretary, President Secretariat Secretary, Prime Minister’s Secretariat Secretary, Supreme Court Registrar General and Law Ministry’s Joint Secretary (Administration-1) have been directed to respond to the Rule on the scheduled date.
Supreme Court lawyer Mohammad Ashraf-uz-Zaman filed the Writ challenging the two years’ contractual appointment of Zahirul Haque as Secretary.
Senior lawyer AJ Mohammad conducted the hearing on behalf of the petitioner while Attorney General Mahbubey Alam appeared in the court for the State.
