The High Court on Thursday ruled that teachers of the government approved private schools, colleges and madrasas cannot be kept under suspension for more than six months.
The High Court bench of Justice M Enayetur Rahim and Justice Md Mostafizur Rahman delivered the verdict after a writ petition was filed in this regard.
The court also directed to include the order that a teacher cannot be kept under suspension for more than six months as per the private teachers’ service rules 1979.
Advocate Md Humanyun Kabir appeared in the court on behalf of the writ petitioner, while Deputy Attorney General Bepul Bagmar represented the state.
Authorities of the Baharbag Secondary School in Magura suspended Md Badshah Miah, an assistant teacher of the school,
in 2007 on charge of taking extra salary. Since the allegation was not settled for a long time, Badshah Miah filed a writ petition with the High Court in 2017 challenging the legality of the suspension order.
After holding a primary hearing on the writ petition the High Court issued a ruling asking the respondents to explain as to why they should not be directed to fix a time limit for the suspension of the private teachers.
Holding detail hearing on the ruling, the High Court on Thursday delivered the verdict. In the verdict the High Court declared the suspension order of Badshah Miah as illegal.
