Gulam Rabbani :
Path to legal battle for the release of BNP Chairperson Khaleda Zia is becoming narrow day by day.
For her release from jail she needs to secure bail in two more cases — Zia Orphanage Trust case and Zia Charitable Trust case — filed by Anti Corruption Commission (ACC). And she will have to go to the Appellate Division for that.
She is convicted in both the cases.
Her lawyer Barrister A M Mahbub Uddin Khokan said, “We are yet to decide over when we will move for hearing on those cases in the Appellate Division. Attorney General opposes bail in every cases of Khaleda Zia. For his (Attorney General) opposition, the attitude of the government can be understood regarding Khaleda Zia’s bail.”
The BNP chief has so far been sued in 37 cases and secured bail in 35 cases, sources said.
She is serving jail after she had been convicted on February 8 last year in a case filed by the ACC.
A Dhaka court sentenced her to five years imprisonment in Zia Orphanage Trust case on February 8 last year. The High Court on October 30 last year enhanced the punishment of Khaleda to 10 years imprisonment in this case.
On March 14 this year, BNP Chairperson filed a leave to appeal petition with the Supreme Court challenging the High Court verdict that enhanced her punishment to 10 years imprisonment from five years in the case.
In the petition, Khaleda Zia prayed to the apex court to suspend her punishment and grant her bail in the case.
The Appellate Division is yet to fix any date for hearing the petition. Even the lawyers of the BNP chief are less interested in hearing about the case.
Besides, a Dhaka court on October 29 last year convicted Khaleda Zia and sentenced her to seven years’ imprisonment in the Zia Charitable Trust corruption case.
The High Court on July 31 rejected Khaleda’s bail petition in the case considering gravity of the offence. Now Khaleda will have to go to the Appellate Division for her bail in the case.
Meanwhile, a rumour has also been heard that BNP Chairperson may get release on parole. Otherwise, she needs to get bail in both the cases.
