The High Court (HC) on Tuesday again summoned Jamuna Bank’s Managing Director Shafiqul Alam to appear in the court on February 12 for not complying with its 2017 directive regarding non-payment of Fixed Deposit Receipt (FDR) for Tk 51 lakh.
The court also ordered the Officer-in-Charge of Motijheel Police Station to arrest and produce Shafiqul in the court if he does not appear himself on February 12.
The HC Bench of Justice Mamnoon Rahman and Justice Ashish Ranjan Das on January 22 ordered Shafiqul to appear in the court on January 29, 2019.
But Shafiqul’s lawyer Habibul Islam Bhuiyan yesterday told the HC that his client could not appear in the court on the date on account of his staying abroad on an official tour.
The HC on January 22 passed the summons following a petition filed by A I M Hasanul Mujib, a businessman.
Mujib submitted an FDR in the name of one Talebur Rahman in the bank’s Nawabpur branch for payment. The deposit matured after five years.
Talebur Rahman gave the power of attorney to Mujib for encashing the FDR from the bank, according to the petitioner’s counsel Barrister A B M Altaf Hossain.
Since the bank did not release the FDR money to Mujib, he knocked at the doors of the Bangladesh Bank but in vain.
He then filed a writ petition with the HC against the authorities concerned of the BB and Jamuna Bank. Subsequently, the HC on February 12, 2017, directed Jamuna Bank to pay Tk 51 lakh to Mujib against the FDR in 30 days.
The Supreme Court’s Appellate Division also upheld the HC verdict, but the bank did not give the money to Mujib.
The HC on January 24 last year issued a contempt of court rule against the BB Governor, the Finance Secretary, the Jamuna Bank’s MD and three others for not complying with its directive.
This is a blatant violation of the court order and contempt of court, Barrister Altaf Hossain said.
