Order on writ challenging MPs oath-taking today

The High Court (HC) on Wednesday fixed today (Thursday) to deliver its order on a writ petition that challenged the oath-taking of lawmakers elected in the December 30 polls last year.
The HC bench of Justice Moyeenul Islam Chowdhury and Justice Md Ashraful Kamal fixed the date for passing order on the petition after concluding hearing on it yesterday.
During hearing, petitioner’s counsel, Barrister A M Mahbub Uddin Khokan, told oath-taking of the persons elected in 11th national polls violated articles 123(3) and 148(3) of the Constitution, as the tenure of the 10th Parliament is yet to expire.
Meanwhile, Attorney General Mahbubey Alam vehemently opposed the writ petition, saying that the petition is not acceptable as the petitioner is neither an elected lawmaker nor he contested in the December 30 election.
Advocate Md Taherul Islam Tawhid, a Supreme Court lawyer, filed the writ petition with the HC on Monday challenging the oath-taking of lawmakers elected in the December 30 polls last year.
In the petition, he prayed to the HC to issue a rule asking the Election Commission and the government to explain as to why the oath-taking of the lawmakers elected in 11th national polls should not be declared illegal.
The petitioner also sought an order from the HC on the authorities concerned so that the lawmakers elected in December 30 elections cannot function.
