Boards ignoring HC order: No initiative to provide SSC, HSC mark-sheets

The education boards of the country are not taking any initiative to implement the direction of the High Court (HC) regarding issuance of mark-sheets of SSC, HSC and equivalent examinations results to the examinees.
Over eight months have already passed since the HC direction, but there is no development in this regard. After the direction, results of the Secondary School Certificate (SSC) and the Higher Secondary Certificate (HSC) examinations of 2015 were published in June and September respectively, but the education boards authorities did not provide mark-sheets to the students.
The result of Junior School Certificate (JSC) is also going to be published at the end of December, but the authorities have no preparation to provide mark-sheets as per the court direction, sources said.
“The authorities are bound to follow the court order. But they have not done anything in this regard till now. What they are doing is absolutely contempt of court, as the education board authorities are ignoring the HC order,” A.K.M. Salahuddin Khan, an advocate of the Supreme Court who stood in the High Court on the issue, told The New Nation on Wednesday. The HC gave the direction on April 4 this year following a writ petition filed by an HSC examinee of 2010 of the Dhaka Board. The examinee-M. Nafees Salman Khan of Government Nazrul College-sought court directive for getting his mark-sheet.
The bench of Justice Dr Quazi Reza-Ul Hoque and Justice Abu Taher Md Saifur Rahman delivered the verdict. The court ordered all the education board authorities to issue mark-sheets to the examinees, if they apply for it.
The Appellate Division of the Supreme Court on November 11 upheld the HC order. “The matter of issuing mark-sheet has been established following the final order of the apex court,” said Salahuddin Khan.
He also said that if the authorities remain insincere to implement the court order, they would draw the attention of the court in this regard.  
In its verdict, the HC observed that it is the right of an examinee to see mark-sheet. So, the examinees have to be given full mark-sheets if they apply for it and the authorities concerned can’t do any negligence.
Petitioner’s counsel Salahuddin Khan said that getting of the examination mark-sheet is a fundamental right, which is protected under the Right to Information Act, 2009 and the country’s Constitution. The lawyer said that the HC in its verdict also observed these.
The HC also directed the authorities concerned of the government and the Dhaka Education Board to give the HSC examination mark-sheet of M. Nafees Salman Khan in 30 days after receiving the copy of the judgment.
The board authorities received copy on August 2. But they did not provide the mark-sheet to his client, said Salahuddin Khan.
Now transcripts with Grade Point Average (GPA) results are issued to students of SSC and HSC examinations.
The education board authorities had earlier issued mark sheets of results to students and they stopped this system in 2001 after the education ministry issued a notification introducing grading system. An amended circular was issued on January 4 in 2003 to this end. Results of SSC examinations were published as per the grading system from 2001 and HSC from 2003.
Narrating the background of the writ petition, Salahuddin Khan said that his client Nafees Salman Khan passed the HSC from the Government Kabi Nazrul College in 2010 with a GPA of 4.30. He was not pleasant in this result. He applied for his transcripts and re-evaluation of his papers. But the Dhaka board authorities did not take any initiative in this regard.
Later, Nafees Salman Khan moved the High Court the following year challenging legality of the two circulars and seeking court order for getting his mark-sheet.
