`Murdered` girl returns alive: HC orders judicial probe

The High Court on Thursday ordered to conduct a judicial inquiry into the incident of rescuing of a teenage live girl, who was said to have been murdered, 51 days after she went missing from Bandar upazila of Narayanganj district.
The Chief Judicial Magistrate of Narayanganj has been asked to conduct the inquiry and to submit a report to the High Court within November 4 this year.
The High Court Bench of Justice M Enayetur Rahim and Justice Md Mostafizur Rahman passed the order after hearing a revision petition filed by five Supreme Court lawyers recently.
The concerned parties including the victim, accused and the state could have a lawyer for themselves during the investigation, said the court in its order.
Advocate Mohammad Shishir Manir took part in the hearing on behalf of the petitioners, while Deputy Attorney General Sarwar Hossain Bappy represented the state.
Mr Shishir Manir said, “The High Court asked the Chief Judicial Magistrate of Narayanganj to conduct the judicial inquiry into the incident. During the investigation, the magistrate will review the FIR and the

statements of the case and make a report on the statements of the victim, the accused and the concerned lawyers.”
The High Court will pass further order on November 5 over the issue, said the lawyer adding that the court said if the accused think that they will keep their lawyer with them while giving their statements during the investigation, then they can do that.
Published reports quoting the police officials said that the underage girl went missing since July 4. Later on August 6, her father filed an abduction case with Narayanganj Sadar Police Station as they failed to find out her.
Following the call list of the missing girl’s mother cell phone, police later arrested three persons, Md Abdullah, 22, Md Rakib, 19, and Khalilur Rahman, 36.
On August 9, the accused testified under Section 164 in separate courts of Narayanganj when they said that they had killed the minor girl after raping her and dumped her body in the Sitalakhya River.
Meanwhile, the minor girl was rescued alive on August 24 51 days after she went missing from Bandar upazila. Following a mobile call police rescued her and handed over her family.
After return the girl said that she willingly married a person named Iqbal and was living with him in Bandar area of the city.
In this circumstance, five Supreme Court lawyers, Md Asad Uddin, Md Jobayedur Rahman, Md Ashraful Islam, Md Al Reza Amir and Md Misbah Uddin filed an application with the High Court on August 25 seeking its interference over the incident of the teenage girl.
The application has questioned the accuracy, legitimacy and rationality of the abduction case that was filed by her father with the Narayanganj Model Police Station after the disappearance of the girl. It also questioned the legality of the confessional statements of the three accused arrested in the case after the case has been filed.
After primary hearing, the High Court on August 27 summoned the two investigation officers of the case. They appeared in the court on September 17 with all the case documents. After hearing them, the court fixed September 24 for further order.
