Mirza Fakhrul to walk out of jail following SC order

The Appellate Division of the Supreme Court on Monday upheld the High Court (HC) order that granted bail to the BNP Acting Secretary General Mirza Fakhrul Islam Alamgir for six weeks.
The BNP leader is now free to walk out of jail, there is no legal bar. He got bail in other cases earlier. A four-member bench of the Appellate Division headed by Chief Justice Surendra Kumar Sinha upheld the HC’s order. The bench also asked Mirza Fakhrul to surrender to a lower court after the bail period expires.
The Appellate Division passed the order after receiving a report from the Bangabandhu Sheikh Mujib Medical University (BSMMU) on the health condition of the BNP leader.
Earlier on July 9, the Appellate Division ordered the BSMMU authorities to form a five-member medical board to examine the health condition of the detained BNP Acting Secretary General and submit a complete report by July 12. The medical board submitted their report within the stipulated time.
Mirza Fakhrul’s lawyer Advocate Khandker Mahbub Hossain told media there is no legal bar to his client’s release from the jail following his bail in all the cases, including the three cases.
Earlier on June 18, the High Court granted bail to the BNP leader in the three cases. The government filed petition against the HC’s order. The Appellate Division on June 28 turned down the government’s petition.
Mirza Fakhrul was admitted to the BSMMU on June 13 following a HC order. On January 6, police arrested him when he was coming out from the National Press Club.
