Chakrabarty passed the order asking Nur Hossain to repatriate Bangladesh by December 15. Earlier, the Indian Home Ministry asked the concerned authorities to withdraw all cases filed against Nur Hossain and send him back to Bangladesh.
West Bengal government prosecutor Bikash Ranjan Dey told journalists that Nur Hossain is a hardcore criminal of Bangladesh.
“Earlier Interpol issued the red warrant against Nur Hossain and his profile has remained on its Red Warrant page on wanted people. As he trespassed into India, cases were filed against him,” the public prosecutor said.
He added as Bangladesh government requested India to return him for his trial, accepting the appeal the court issued the order to make an arrangement to repatriate him to his country.
“The government had filed an appeal for withdrawal of the charges against Hossain under Sec 321 of Indian Penal Code, which judicial magistrate Chakrabarty accepted on Thursday,” Bikash Ranjan Dey said.
He said the West Bengal police will hand over Nur Hossain to the Border Security Force, who will later handover him to the Border Guard Bangladesh in Benapole-Petropole borders.
On June 14 in 2014, the West Bengal police arrested Nur Hossain from an apartment in Kolkata. Since then he has been languishing in jail there. He was also placed before the court in several times.
According to the Interpol website, the red warrant was issued against Nur for his alleged involvement with six crimes, including murder, hiding evidence of the crime, kidnapping persons with intent to wrongful confinement, wrongful restraint, impersonating a public servant and group involvement in crime.
As the new extradition treaty between Bangladesh and India has been signed there would be no bar to send back Nur Hossain to Bangladesh, the public prosecutor said.
