Bangladesh oldest mobile phone operator Citycell’s appeal against the cancellation of its operation will be heard on 31 October at a regular bench of Appellate Division of the Supreme Court.
Chamber Judge Justice Hasan Fayez Siddique of the Appellate Division on Tuesday set the hearing
date, confirming that Citycell cannot resume operation before October 31. Citycell submitted a petition on Monday seeking injunction on the decision of Bangladesh Telecommunication Regulatory Commission (BTRC) cancelling the allocation of the spectrum.
Barrister Shafique Ahmed, Advocate A M Amin Uddin and Barrister Mahbub Shafique represented Citycell in the court while Attorney General Mahbubey Alam stood for the state. Sheikh Fazle Noor Taposh and Reza-e-Rakib pleaded for the BTRC.
BTRC lawyer Reza-e-Rakib told the journalists that chamber judge had fixed the date of hearing at a regular bench of Appellate division without giving any stay order on the government decision canceling citicell’s spectrum. The appeal will be heard on October 31.
On October 20, the BTRC suspended the spectrum of Citycell as it failed to pay the outstanding dues of Tk 477.63 crore.
On August 29, the Appellate Division ordered Citycell to pay its Tk 477.51 crore dues to BTRC in two installments to continue its operation.
The apex court had asked the mobile phone operator to pay the first slot of Tk 318.42 crore, two-thirds of the total outstanding payment, within October 19.
As Citycell failed to pay the two-thirds of the total amount within the stipulated time, the BTRC took the decision to suspend the operations of the mobile phone operator as per the law.
