The Supreme Court on Thursday upheld the High Court (HC) judgment that had declared 5 percent mandatory quota for the offspring of freedom fighters in MBBS admission every year to medical colleges as prescribed by the Ministry of Liberation War Affairs.
A four-member Appellate Division Bench of the Supreme Court, headed by Chief Justice SK Sinha, passed the order, dismissing the application for a leave-to-appeal filed by the government against the March 6 last year HC judgment. With the day’s apex court judgment, the existing stay on the operation of the HC judgment stands vacated, said the SC order.
Liberation War hero Delwar Hossain, a deprived father, filed the writ petition in the form of public interest litigation (PIL) as the medical colleges did not duly comply with the circular of the Ministry of Liberation War Affairs. Advocate Sikder Moqbul Huq appeared for the petitioner.
