The High Court on Monday stayed till 11:00am of Tuesday the joining of newly appointed Principal of Viqarunnisa Noon School and College Professor Fouzia Rezwan.
The court asked Deputy Attorney General Amit Das Gupta to ensure that Fouzia could not join the post of the principal till 11:00am today (Tuesday).
The High Court Bench of Justice M Enayetur Rahim and Justice Md Khairul Alam passed the order while hearing a writ petition filed by a Supreme Court lawyer, Eunus Ali Akond, challenging the legality of Fouzia’s appointment.
Advocate Eunus Ali Akond took part hearing in the court on behalf of the writ petition while Deputy Attorney General Amit Das Gupta stood for the state.
Citing from the writ petition, the lawyer said, “The governing body of Viqarunnisa Noon School and College is the authority to appoint its principal whereas the government has authority to appoint the teachers.”
“But the government has illegally appointed Fouzia as the principal of the institution on September 15 though it has no jurisdiction to do so as per relevant rules and regulations,” he said in the petition.
During the hearing, DAG Amit Das Gupta told the court that he would place before the HC the relevant law under which the government has appointed Fouzia as the Principal of the institution.
Later, the court passed the order and adjourned hearing of the writ petition till 11:00am of Tuesday.
The petitioner prayed to the court to issue a rule upon the respondents to explain as to why the appointment of Professor Fouzia Rezwan as the principal of Viqarunnisa Noon School and College should not be declared illegal.
Education Secretary, Chairman of Dhaka Education Board, Principal of Viqarunnisa Noon School and College, Chairman of ad hoc committee of Viqarunnisa Noon School and College, Deputy Commissioner of Dhaka and six others have been made respondents in the writ petition.
In 2018, Principal Nazneen Ferdous and two other teachers of the institution were removed over the suicide of Aritry Adhikari, a student of the school.
Later, the authorities concerned of Viqarunnisa Noon School and College appointed its Assistant Professor Ferdousi Begum as the acting Principal.
