HC starts hearing writ on ‘fictitious’ cases

The High Court has begun hearing on a writ petition filed over “fictitious” cases lodged against opposition party activists across the country.
After concluding Tuesday’s hearing, the Bench of Justice Md Nazrul Islam Talukder fixed Thursday for further hearing in this regard.
Advocate Khandker Mahbub Hossain, one of the petitioners, finished his arguments on Tuesday, Deputy Attorney General AKM Amin Uddin Manik told the reporters.
Attorney General Mahbubey Alam will place arguments on Thursday.
On the today’s (Tuesday) hearing, Advocate Mahbub told the court, thousands of false cases
had been filed arbitrarily against hundreds of thousands of opposition activists with ill political motive.
Even, the deceased were made accused, he said.
The lawyer prayed for a rule on the government to explain the legality of filing such cases and on what actions to be taken against the police officers who filed the cases.
DAG Amin Uddin opposed the petition saying that every case will be investigated and if any innocent man or dead person is made accused in the cases, they will be exempted from the charges.
Earlier on October 9, a two-judge HC Bench delivered a split order in the same writ petition.
After that, Chief Justice Syed Mahmud Hossain assigned the Bench of Justice Nazrul Islam Talukder for hearing and disposing of the petition.
Three pro-BNP lawyers, who also stand accused in such cases, filed the petition, seeking the court’s directives on the government to form a probe body to investigate the legitimacy of these cases numbering around 4,000.
