The High Court (HC) on Wednesday asked the Home Secretary and Inspector General of Prisons to submit a written explanation in the court over the mismanagement in Panchagarh jail and over the death of an Advocate inside the jail.
They have to submit the explanation on October 15.
The HC bench of Justice Sheikh Hassan Arif and Justice Md Badruzzamna passed the order after
hearing a writ petition filed in connection with the death of a lawyer, Palash Kumar Roy.
On May 8, the High Court Justice Sheikh Hassan Arif and Justice Razik-Al-Jalil formed a judicial committee led by the Chief Judicial Magistrate of Panchagarh to inquire into the death of Advocate Palash Ray in a fire inside the jail.
Another Judicial Magistrate will provide necessary assistance to the judicial committee which comprised the Chief Judicial Magistrate, Deputy Commissioner, Superintendent of Police and the Jail Super of Panchagarh, the High Court said in response to a writ petition.
Complying with the HC order, the probe committee submitted a report in the court yesterday. The scenario of the mismanagements in the prison was articulated in the report.
Barrister Sayeedul Hoque Sumon read a part of the probe report submitted by the committee.
During the hearing on the report, the court said, “Apparently this is the case of suicide.”
Barrister Sayeedul Hoque Sumon appeared in the court on behalf of the writ petition while Deputy Attorney General Bipul Bagmar stood for the state.
It was said in the report that the prisoners randomly use gas lighter inside the Panchagarh jail and there is no fire fighting system and close-circuit camera.
Only a diploma graduated nurse is working in the Panchagarh jail hospital and a murder case accused is conducting the duty of the surgical department inside that jail, read the probe report. In the hearing, Barrister Sumon said, Advocate Palash was given treatment after minimum 24 hours of the incident. A lot of time went into official and ancillary work.
Barrister Suman submitted that Palash was detained for making remarks against the Prime Minister and the local administration at a human chain held in front of the office of Panchagarh Deputy Commissioner on March 25.
The lawyer also submitted that Palash was picked up by the police from the human chain he had organised and his family members demanding withdrawal of a case filed against him by Kohinoor Chemical Company.
