HC rules over removal of BERC Member Aziz Khan

The High Court on Tuesday issued a rule upon the concerned bodies of the government to explain in seven days as to why the inaction of the respondents to initiate proceeding against Md Abdul Aziz Khan, a Member of Bangladesh Energy Regulatory Commission (BERC), Under Section 11 of BERC Act, 2003 should not be declared illegal.
Section 11 of Bangladesh Energy Regulatory Commission Act, 2003 contains the criteria for removal of the Chairman and Member of BERC and the procedure of the removal.
The High Court Bench of Justice M Enayetur Rahim and Justice Md Mostafizur Rahman passed the order after hearing a writ petition filed by Consumer Association of Bangladesh (CAB), represented by its Convener Architect Mubashsher Hossain.
Energy and Mineral Resources Division Secretary, Bangladesh Energy Regulatory Commission, Chairman of Bangladesh Energy Regulatory Commission, Chairman of Anti-Corruption Commission (ACC), and Md Abdul Aziz Khan, a member of Bangladesh Energy Regulatory Commission (BERC), have been made respondents in the petition.
The petition said, Md Abdul Aziz Khan, a member of Bangladesh Energy Regulatory Commission (BERC), is a charge-sheeted accused of a criminal case filed for theft of 0.14 million metric ton coal from the Boropukuria Coal Mine.
The case was filed by the Manager (Administration) of Boropukuria Coal Mine Company Limited (BCMCL) against 19 persons with the Parbotipur Police Station of Dinajpur district. Thereafter, the Anti-Corruption Commission on July 21, 2019 submitted the charge-sheet against 23 accused persons including Md Abdul Aziz Khan.
After submission of the charge-sheet in the case filed in connection with corruption in the Boropukuria Coal Mine, the Magistrate issued warrant of arrest against 23 accused named in the charge-sheet including Md Abdul Aziz Khan. In the meantime, Md Abdul Aziz Khan surrendered to the Magistrate and obtained bail in the corruption case.
Barrister Jyotirmoy Barua appeared in the court on behalf of the petitioner, while Deputy Attorney General Amit Talukder stood for the State.
