HC rules over pry teachers selected through BCS

The High Court on Monday issued a rule upon the concerned bodies of the government to explain in four weeks as to why they should not be directed to recommend the headmasters of the government primary schools, who have been selected through 36th BCS examination, for the posts of Upazila Assistant Education Officers or any other posts for second class gazetted officers.  
The HC bench of Justice FRM Nazmul Ahasan and Justice KM Kamrul Kader passed the order after hearing a writ petition filed by

 74 primary headmasters who have been selected for the non-cadre posts through 36th BCS examination.
Advocate Siddique Ullah Miah appeared in the court on behalf of the writ petitioners while Deputy Attorney General ABM Abdullah Al Mahmud Bashar stood for the state.
In the rule, the HC also wanted to know from the government as to why their inaction in appointing the writ petitioners as the Upazila Assistant Education Officers or in any other posts for second class gazetted officers should not be declared illegal or as to why the government should not be directed to appoint them as Upazila Assistant Education Officers or in any other posts for second class gazetted officers.
Seven respondents, including Public Service Commission, have to comply with the rule.
Advocate Siddique Ullah Miah said, the writ petitioners passed the 36th BCS examination and they were recommended for the posts of the headmasters of the government primary schools, which is a non-cadre post.
“As per appointment policy of the Public Service Commission, they cannot recommend any one for any post below second class gazetted officer. But they are doing so by recommending the BCS passed candidates for the posts of the headmasters of the government primary schools, which are second class posts but non gazetted,” added the lawyer.
