The High Court on Tuesday issued a ruling about the postponement of the election of the Board of Directors of the Federation of Bangladesh Chambers of Commerce and Industry (FBCCI).
In the ruling the High Court wanted to know from the respondents in four weeks as to why the inaction of the DTO (director, trade organization, ministry of commerce) to postpone the election of the Board of Directors of the FBCCI in the midst of lockdown and coronavirus surge situation should not be declared illegal.
It also wanted to know in the ruling as to why the
memo dated April 7, 2021, of the commerce ministry allowing the election to continue should not be declared illegal.
The court also directed the DTO to dispose of the representation submitted on April 14 this year to postpone the election within seven days.
The High Court bench of Justice M Enayetur Rahim and Justice Sardar Md Rashed Jahangir passed the order after holding hearing on a writ petition filed in this regard.
Senior secretary of commerce ministry, secretary of cabinet division, DTO of commerce ministry, senior assistant secretary (TO-2) of trade organization wing of commerce ministry, chairman of the election appeal board of the election to the FBCCI, chairman of the election board of the election to the FBCCI and the FBCCI represented by its President have been asked to comply with the ruling.
Md Amir Uddin Bipu, proprietor of H B Enterprise, member of the general body of the FBCCI, filed the writ petition demanding the postponement of the election in the midst of lockdown and coronavirus surge situation.
Advocate Khurshid Alam Khan and Barrister Shanjid Siddique appeared in the court on behalf of the writ petitioner, while deputy attorney general Bipul Bagmar represented the state.
According to the election schedule, the election of the Board of Directors of the FBCCI will be held on May 5 this year for two years term of 2021-2022 and 2022-2023.
The writ petition said, “Considering the surge in Covid-19 infection, the DTO has extended the time for holding election to the executive committee of the trade associations up to 31st December, 2021 through a notification issued on April 7. However, in the said letter, the DTO allowed the trade associations who have already declared their election schedule to continue with the election process.”
“Then the writ petitioner made a representation to the chairman of the election board and subsequently to the DTO requesting to postpone the election scheduled to be held on May 5 due to the current upsurge in the coronavirus infection rate in the country. However, no steps have been taken as of date.”
