The High Court (HC) on Thursday issued a rule upon Shawkat Chowdhury, MP, from Nilphamari-4 Constituency, to explain in 10 days as to why his bail in two cases filed by the Anti-Corruption Commission (ACC) for bank loan defalcation should not be cancelled.
The HC bench of Justice M Enayetur Rahim and Justice J B M Hassan passed the order as suo moto while hearing on bail petitions filed by another two accused of the cases.
The court has set December 7 for holding further hearing on the case, said Barrister M Sarwar Hossain, Counsel for Bangladesh Commerce Bank.
The day was fixed for hearing on a rule issued in connection with the bail petition of the bank’s Managing Director Dr Md Asaduzzaman and Manager of it’s Bangsal Branch Habibul Ghani.
‘During the hearing, counsels of the both accused told the court that the main accused of the loan scam, Shawkat, had been granted bail by the lower court. At this point, the court passed the order acting on its own motion,’ said Barrister Sarwar.
According to the lawyer, the capital of the bank is around Tk 200 crore. But Shawkat and others embezzled Tk 102 crore, which is half of total capital of the bank.
Anti-Corruption Commission filed two cases with Bangsal PS in 2015 against nine persons including Shawkat Chowdhury.
