HC rule over holding PWD Chief Engineer`s post by Hafiz

The High Court on Sunday issued a rule asking the government to explain under which authority Hafizur Rahman alias Tipu Munshi has been holding the post of acting chief engineer of the Public Works Department.
An HC bench comprising Justice Obaidul Hassan and Justice Krishna Debnath issued the rule following a writ petition.
It issued another rule asking the government to explain why the Freedom Fighter certificate and inclusion of the name of Hafizur Rahman in the
gazette notification issued by the government in 2010 should not be cancelled and declared illegal. The Housing and Public Works secretary, Liberation War Affairs secretary and Hafizur Rahman have been made respondents to the rule, which is returnable in four weeks.
Advocate Kamal Hossain, a petitioner’s lawyer, said Tipu Munshi did not introduce himself as a freedom fighter when he joined the service in 1981. But in 2010, he claimed himself as a freedom fighter and submitted his documents to the ministry. On July 25, 2010, the government issued a gazette notification over freedom fighters’ facilities where Tipu’s name was included.
Later, a question was raised from different quarters over the legality of Tipu’s freedom fighter status as different reports were published in several dailies over the issue.
The Liberation Affairs Ministry investigated the matter and after investigation the ministry asked the director general of Jatiya Muktijoddha Council to cancel his freedom fighter certificate and exclude his name from the gazette on August 22. On December 28, 2013, Tareque Hasan Khan, a Dhaka court lawyer, filed the writ petition challenging the legality of Tipu Munshi’s post.
