Embezzling relief fund: HC rule over enhancing Mannan’s sentence

The High Court on Tuesday issued a rule asking the concerned bodies of the government to explain as to why the one-year imprisonment sentence given by a lower court in a corruption case to former Gazipur City Corporation Mayor MA Mannan should not be enhanced.
The HC Bench of Justice Md Nazrul Islam Talukder and Justice Mohi Uddin Shamim came up with the ruling after holding
hearing on a petition filed by the Anti-Corruption Commission (ACC) seeking enhancement of Mannan’s jail sentence.
Lawyer Khurshid Alam Khan appeared for the ACC, while Deputy Attorney General AKM Amin Uddin Manik represented the State.
A special court of Dhaka on November 18, 2020, delivered the sentence to Mannan in a case filed by the ACC on charge of embezzling around Tk 5.0 million through fake vouchers.
At the same time, the trial court fined Mannan Tk 5.0 million and ruled that he will be sentenced to three more months in jail in defaulting to pay the fine.
However, the court granted bail to the former mayor immediately as he sought bail saying he will file an appeal petition against the verdict.
The court also acquitted the other accused Golam Kibria from charges.
In the petition, the ACC said there is a specific allegation against Mannan of embezzling state money, but the trial court has sentenced him to only one-year imprisonment and fined him Tk 5.0 million, which is not sufficient.
The HC Bench set April 11 for further hearing on the matter. According to the case statement, MA Mannan during his tenure (August 18, 2013 to February 2, 2015) misappropriated an amount of Tk 4.9 million from the relief fund of GCC using some fake vouchers.
Over the incident, ACC Deputy Assistant Director Shamsul Alam filed a case against Mannan and his associate Golam Kibria at Joydebpur Police Station in Gazipur on 23 June, 2016.
The ACC pressed charges against the duo on 12 January, 2017. The Gazipur Special Judge’s Court then took the case in cognizance and transferred it to the Dhaka Divisional Special Judge’s Court for further trial.
On 17 January, 2019, the Dhaka Divisional Special Judge’s Court framed charges against them. A total of six people testified in the case at different times.
