HC rule on Square Hospital to pay Tk 5 cr for wrong treatment

The High Court on Thursday issued a rule upon the Square Hospital and other respondents to explain as to why the impugned inaction of the respondents in not taking steps to provide full medical support and treatment to the petitioner in connection with the physical damage caused to him by way of negligence during surgery carried out in the Square Hospitals Limited on January 23 in 2019 should not be declared illegal.
The court also said in the ruling as to why the respondents should not be directed to pay compensation of Tk five crore for wrong treatment to the petitioner and to provide necessary medical treatment and support to the petitioner free of cost for his entire life.
The High Court bench of Justice J B M Hassan and Justice Md Khairul Alam passed the order after hearing on a writ petition filed by Mehedi Hasan Shamim who received treatment from the Square Hospital.
The petitioner went to Square Hospital for medical check-up and sought advice from Dr Krishna Prabhu, an Indian national and resident doctor of the hospital. The doctor opined that the petitioner was suffering from brain tumor and he needs to go for a surgery immediately. Therefore, on January 1, 2019, the petitioner had gone through the surgery by the doctor.
After the surgery in the Square hospital, the on duty doctor informed the brother of the petitioner that after surgery the left side of his body had not been functioning.
The court also directed the Square Hospital to transmit all medical records of the petitioner, including the operation CD, to the High Court within 30 days from the date of issue of this order.
Health Secretary, Director General of Directorate General of Health Services, President of Bangladesh Medical and Dental Council, MD and CEO of Square Hospital and Professor Dr Krishna Prabhu have been made respondents in the petition.
Advocate Jyotirmoy Barua appeared in the court for the petitioner.
It was said in the petition that the petitioner after completion of his master’s degree from the University of Dhaka was trying for job and he had applied in a good number of companies. The petitioner used to live a healthy life during and after completion of his studies and he had no major health issue until last August 2018. On August 28, 2018, he suddenly fell unconscious and he was taken to the Dhaka Medical College Hospital.
