The High Court (HC) on Sunday rejected a writ petition seeking its directive on the government to transfer Barguna’s Rifat Sharif murder case to the Criminal Investigation Department (CID) or the Police Bureau of Investigation (PBI) from the local police for the sake of fair investigation.
The court said, writ petitioner Eunus Ali Akond has no locus standi (jurisdiction) for moving the writ petition as accused Aysha Siddika Minni, the wife of Rifat Sharif, or her family did not give him permission to file the petition.
The court further said that it would not interfere into this case at this stage.
The HC bench of F R M Nazmul Ahsan and Justice K M Kamrul Kader rejected the petition considering that it was not placed properly.
The court also observed if police had remained alert, Rifat Sharif would not have been killed.
The bench asked Deputy Attorney General A B M Abdullah-Al Mahmud Bashar to communicate with the local administration so that they take proper steps against the real culprits and do not become more enthusiastic about Minni.
On July 25, Eunus Ali submitted the petition requesting the HC to cancel the remand order against Minni and the statement given by her in court in connection with the case. The petition also requested Minni’s immediate release.
In the petition, he also prayed to the HC to order the government to form a judicial inquiry committee to probe into the killing of Sabbir Hossain Nayan alias Nayan Bond, the principal accused in the case, in a “gunfight” with the law enforcers on July 2.
On June 26, Rifat Sharif, a 25-year-old internet service provider, was hacked by a group of young men in broad daylight.
In a footage of the incident that went viral on social media, the victim’s wife Minni was seen screaming and trying to save her husband from the assailants.
Although Minni was named as a witness in the case, police later showed her as an accused. They claim that they had found her involvement in the murder during investigation.
