HC rejects bail petition of ACC official Basir

The High Court on Tuesday rejected a bail petition filed by Khandaker Enamul Basir, suspended Director of the Anti-Corruption Commission (ACC), in a case filed for transaction of Tk 4.0 million as bribe.
The court, however, asked the trial court concerned to finish the trial proceedings of the case within one year.
The High Court bench of Justice Md Nazrul Islam Talukder and Justice KM Hafizul Alam delivered the verdict after rejecting a rule issued earlier over bail to Enamul Basir.
On February 11 this year, the same High Court bench issued the rule to explain in two weeks as to why Khandaker Enamul Basir should not be granted bail in the case.
Advocate Faruque Alamgir Chowdhury appeared in the court on behalf of Enamul Basir, advocate Khurshid Alam Khan appeared for the ACC and deputy Attorney General AKM Amin Uddin Manik stood for the state.
In the hearing, Faruque Alamgir said, “The allegation leveled against Basir has no basis. It was said in the allegation that the bribe transaction was held in the Ramna Park which is a public place. It is not possible to transact bribe there. Enamul Basir had investigated many big cases of ACC. No allegation was raised earlier against him. Besides, he is sick. So, he can get bail in the case.”
Opposing Basir’s bail petition, advocate Khurshid Alam Khan said, “ACC has already submitted the charge sheet in the trial court and the court has accepted the charge sheet into cognizance. So, he should not get bail at this stage.”
Enamul Basir, temporarily suspended by the commission earlier, was arrested by an ACC team led by its Director Sheikh Md Fanafillah from the city’s Darussalam area on July 22, 2019.
On July 23, a Special Court of Dhaka rejected his bail petition and sent him to jail. Then he filed bail petition with the HC through his lawyer.
Following his petition, another High Court bench on September 3, 2019, refused to grant bail to Khandaker Enamul Basir in the case. His lawyer took back the bail petition as the High Court bench of Justice Farid Ahmed and Justice ASM Abdul Mobin didn’t agree to grant him bail or to issue a rule in this regard.
He was again rejected bail on January 5 this year from another special court. Then he moved to the High Court on February 6 for his bail. After hearing the petition, the court delivered the verdict on Tuesday.
The ACC official was accused in a case of receiving bribe of Tk 4.0 million from suspended Deputy Inspector General (DIG) of Bangladesh Police Mizanur Rahman.
On July 16, 2019, Md Fanafillah filed the case against the two government officials with the ACC’s Dhaka District Coordination Office-1 in Dhaka. DIG Mizan was shown arrested on the same case on July 21.
