Change in FIR: HC orders for judicial probe into allegations against Puthia OC

The High Court on Monday ordered for a judicial probe into the allegations of bringing change in the statement of a murder case of labour leader Nurul Islam by the Officer-in-Charge (OC) of Puthia Police Station of Rajshahi Shakil Uddin Ahmed.
The court asked the chief judicial magistrate of Rajshahi to comply with this order and submit a report in the High Court within 45 days.
At the same time, the court issued a rule upon the respondents to explain as to why the OC should
not be suspended from his duty and as to why the respondents should not be directed to take departmental action against him.
The High Court Bench of Justice M Enayetur Rahim and Justice Md Khairul Alam passed the order after hearing a writ petition filed on September 8 by deceased’s daughter, Nigar Sultana.
Barrister Jyotirmoy Barua and Barrister Abu Bakar Siddiquee appeared in the court on behalf of the writ petitioner, while Deputy Attorney General Amit Das Gupta stood for the State.
Seven respondents including Home Secretary, Chairman of Anti-Corruption Commission (ACC), Inspector General of Police (IGP), Police Superintendent (SP) of Rajshahi and Officer-in-Charge of Puthia Shakil Uddin Ahmed have to comply with the rule within four weeks.
Body of Nurul Islam, a local labour leader of Puthia, was recovered from a brickfield of Kathalbaria area of Puthia on June 11, 2019. Nigar Sultana, daughter of Nurul Islam, submitted a statement in the Police Station in this regard.
Later Nigar alleged that the OC brought change in the case statement submitted by her. She also made a written complaint to the Police Superintendent of Rajshahi, Md Shahidullah, on July 18 against the OC citing the change in the statement. The same day, she filed a petition to the judicial magistrate of Rajshahi to scrap the case.
As Nigar didn’t get any remedy from them, she filed a writ petition with the High Court on September 8.
