The High Court has ordered clearing of 2,181 establishments illegally set up on the banks of Karnaphuli River, the lifeline of Chittagong, within three months.
The bench of Justice Md Rezaul Hasan and Justice Kashefa Hussain gave the order on Tuesday.
It has ordered the Chittagong Development Authority secretary, chief executive officer of Chittagong City Corporation, BIWTA chairman and the district’s deputy commissioner (DC) to serve notice in local newspapers on the owners within seven days.
Following a petition filed by the Human Rights and Peace for Bangladesh (HRPB), the court on Jul 18 issued a rule directing the Chittagong DC to conduct a survey and submit a list of establishments illegally erected in the area.
Giving the order on that rule, the court on Tuesday said the matter will be under its observation. Advocate Manzil Murshid, who also heads petitioner HRPB, told reporters: “Six of the 2,181 enlisted establishments that belong to the Navy and the (Chittagong) port authorities have been spared from eviction drives.
“However, they have been asked to appeal to the Department of Environment (DOE) for clearance.”
“These establishments might be reconsidered if they are proved to do public good.” The DOE director has been ordered to remove the establishments from the Karnaphuli River banks within three months based on the data from the survey, Murshid said.
The DC and police along with the respondents have been ordered to assist the eviction.
