The High Court (HC) on Tuesday fixed tomorrow (Thursday) to pass an order on a writ petition filed by BNP Chairperson Khaleda Zia challenging the legality of the government’s decision to take her back to jail from Bangabandhu Sheikh Mujib Medical University (BSMMU).
The HC bench of Justice Sheikh Hassan Arif and Justice Razik-Al-Jalil passed the order after hearing on the petition, Barrister Kayser Kamal, a lawyer for Khaleda, told the reporters.
During hearing, Khaleda’s lawyer A J Mohammad Ali told the HC that the government had taken Khaleda Zia back to jail without completing her treatment at BSMMU, which is a violation of her fundamental rights.
“She was taken back to jail without the recommendation of the medical board formed by the High Court on October 4, 2018, for her treatment. She was released from the hospital with consent of the duty doctor only,” A J Mohammad Ali said in the hearing.
Additional Attorney General Murad Reza opposed the writ petition saying that Khaleda Zia was released from the BSMMU as its medical board concerned recommended that she could be given treatment as an outdoor patient.
Producing relevant papers, he said there was no necessity to keep Khaleda Zia in BSMMU for treatment.
Khaleda Zia submitted the petition on Sunday through her lawyer Barrister Nawshad Jamir also seeking HC order on the government to send her to a specialised hospital for treatment.
She was admitted to BSMMU on October 6 as per HC directive and was taken back to jail on November 8.
On October 4, the High Court directed the government to immediately admit BNP Chairperson Khaleda Zia to Bangabandhu Sheikh Mujib Medical University (BSMMU) for her treatment and to reconstitute the five-member medical board formed by the government.
