The High Court (HC) on Tuesday fixed today (Wednesday) for passing order on a writ petition filed seeking its directives about the alleged abuse of power by 12 judicial officers. The respondents include Supreme Court Registrar General Dr Md Zakir Hossain, Assistant Registrar of the High Court Division of the Supreme Court Md Harun Reza, Narayanganj District and Sessions Judge Mohammad Anisur Rahman, Senior Judicial Magistrates of Narayanganj Nur Nahar Yesmin and Fahmida Begum.
The HC bench of Justice Hassan Arif and Justice Razik Al Jalil fixed the date after hearing the writ petition filed by Managing Director of Satco Electronic Industries Sayed Ahmed Patwary.
Advocate Md Emdadul Haque Kazi appeared in the court on behalf of the petitioner.
Citing from the petition, the lawyer said, Senior Judicial Magistrates of Narayanganj Fahmida Begum without any local inquiry by the local Police or otherwise took cognizance and issued arrest warrant against the petitioner and other two persons at the influence and instruction of the Supreme Court Registrar General Dr. Mohammad Zakir Hossain.
“Senior Judicial Magistrate of Narayanganj Nur Nahar Yesmin passed an order on February 28, 2019 without giving the petitioner any opportunity of being heard and passed the said order on a date was not fixed for and thus violated the very principle of Rule of Law and the fundamental rights of the petitioner,” the petition read.
“Senior Judicial Magistrate of Narayanganj Nur Nahar Yesmin as a Judicial Magistrate has neither any jurisdiction to settle any civil dispute nor passed any order directing any authority to deliver possession of any disputed rented premises and yet being benefitted illegally from one Md Abul Khair and following illegal instruction of the Supreme Court Registrar General and others,” the petition also read.
