The High Court on Monday issued a rule asking the Election Commission (EC) and others to explain why winner Jabunnesa Afroz Hiron from the by-election to Barisal-5 constituency should not be declared disqualified.
Issuing the order, the HC also asked the EC to explain why its failure to take steps against her previous offences under the RPO should not be declared illegal.
An HC division bench comprising Justice Zinat Ara and Justice Nurul Huda came up with the rules upon a writ petition.
Among others, the Speaker, the Law Ministry, the Law Secretary, MP Jabunnesa have been made respondents to the rule, returnable in four weeks.
Bangladesh National Forum (BNF) candidate M Shahidul Islam Liton who lost the election race filed the writ petition.
Jebunnesa, nominated by the ruling party, won the by-election to Barisal-5 constituency on June 15.
