HC drops law officer’s plea challenging ACC notice

The High Court on Monday dropped a writ petition from its cause-list which was filed by deputy attorney general Jannatul Ferdousi Rupa challenging the legality of a notice issued by the Anti-Corruption Commission (ACC) asking her to appear before it on allegations of amassing wealth beyond known income sources.
The High Court bench of Justice Md Nazrul Islam Talukder and Justice Ahmed Sohel passed the order after it had come for hearing.
Advocate ZI Khan Panna and advocate Suraiya Begum appeared in the
court on behalf of Jannantul Ferdousi Rupa, while deputy attorney general AKM Amin Uddin Manik represented the state and advocate Khurshid Alam Khan appeared for the ACC.
During yesterday’s hearing, the presiding judge of the bench wanted to know about the subject-matter of the writ petition when it had placed before the court. Then lawyer Suraiya Begum said that deputy attorney general Jannatul Ferdousi Rupa was the petitioner of this writ petition.
The judge then said, “She is my neibhour. We live in flats alongside. So it will be better if you take it (writ petition) to another bench for hearing.”
An inquiry was initiated in October this year against her and ACC deputy director Mohammad Ibrahim served a notice to her on October 28 asking to appear in the commission on November 4 to face interrogation.
After receiving the ACC notice Jannatul Ferdousi Rupa on last Sunday filed the writ petition with the High Court.
According to the notice, DAG Jannatul Ferdousi Rupa had allegedly amassed wealth beyond known income sources through irregularities, corruption, abuse of power, bribery, forgery and collusion with several accused individuals, including expelled Juba League leader, GK Shamim.
Home Secretary, ACC Chairman, ACC Director General (Special Enquiry and Investigation-2) and ACC Deputy Director (Special Enquiry and Investigation-2) have been made respondents in the writ petition.
