HC clears way for evicting MP Aslamul’s establishments from river bank

The High Court on Wednesday cleared the way for the Bangladesh Inland Water Transport Authority (BIWTA) to evict the establishments owned by ruling party lawmaker from Dhaka-14 Constituency, Aslamul Haque, from the bank of Buringanga River.
The court rejected a rule issued earlier in this regard following a writ petition filed by Aslamul Haque
seeking directives for stopping eviction activities against his three companies setup after grabbing the land of Buriganga River.
The three companies are— CLC Power Company Limited, Dhaka North Power and Utility Company Limited and Dhaka West Power Limited.
The High Court bench of Justice Md Ashfaqul Islam and Justice Mohammad Ali delivered the verdict after holding hearing on the petition.
Advocate Md Ozi Ullah took part in the hearing on behalf of Aslamul Haque, while advocate Manzill Murshid appeared for the National River Conservation Commission and advocate Kamrunnahar Dipa represented the BIWTA.
Now there is no bar for the Bangladesh Inland Water Transport Authority (BIWTA) to evict the illegal establishments set up on the bank of the river, said lawyer Manzill Murshid.
In an eviction move Bangladesh Inland Water Transport Authority on March 3 this year demolished a part of the boundary wall of the establishments setup after grabbing the land of Buriganga River.
Then the MP filed a writ petition with the High Court challenging the eviction activities and seeking compensation for the damage.
Upon hearing the petition, the High Court on October 22 this year issued a rule over the matter and asked Bangladesh Inland Water Transport Authority to dispose of in 30 days the application submitted by the companies for conducting a joint survey to determine whether the companies had grabbed river land or not.
Following the High Court’s direction, the district administration and some other government organizations held a joint survey over the disputed land.
The National River Conservation Commission on November 9 this year submitted a report in the court saying that the establishments of MP Aslamul Haque had been setup by grabbing land of the river and others.
After holding hearing on the report submitted by the National River Conservation Commission, the High Court rejected the rule issued earlier in this regard.
The NRCC has said in their report that the establishments of Aslamul Haque have been setup illegally grabbing about 54 acres of land on the banks of Buriganga and Turag Rivers near Keraniganj in Dhaka of the 54 acres of land, 13 acres land is part of main river, said the report.
