HC calls all record of Evaly: Police to quiz CEO Rassel at jail gate

The High Court on Thursday called for all record of the controversial e-commerce platform Evaly Limited to examine whether a board of directors can be formed to run the company properly.
The Registrar of the Joint Stock of Companies and Firms (RJSC) has been directed to send the entire record of the company on October 12 this year to this court.
The HC bench of Justice Muhammad Khurshid Alam Sarkar passed the order after hearing a petition filed under the Companies Act-1994.
For an effective and fair disposal of this matter, the whole record of the Evaly Limited, which is now under the custody of the Registrar of the Joint Stock of Companies and Firms, may be required for examination said the court.
Accordingly, the Joint Stock of Companies and Firms is directed to send the entire record of the company (Evaly) on October 12 to this court.
The court also asked AKM Badruddoza, a counsel for the RJSC, to communicate the order to the RJSC so that he can assist the court towards expeditious disposal of the matter.
Md Farhad Hossen, a customer of the Evaly, filed the petition on September 22 seeking HC directives to wind up the Evaly and disburse net asset cash fund among the customers.
He also sought a court order to direct the respondents to restrain or prohibit Evaly from selling, transferring and disposing of its assets.
Farhad Hossen also made a plea for formation of a board of directors to take control of the e-commerce entity’s affairs, management and business.
Barristers AM Masum and Syed Mahsib Hossain appeared in the court on behalf of the petitioner.
BSS adds: The court has directed concerned authorities to interrogate Evaly managing director (MD) Md Rassel at the jail gate for a day, within three days, in an embezzlement case of Tk85,000.
Dhaka Metropolitan Magistrate Sadbir Yasir Ahsan Chowdhury passed the order after a hearing on Thursday as police produced Rassel and his wife Evaly Chairman Shamima Nasrin before the court.
Following that, the investigating officer (IO) of Dhanmondi police station requested to show them arrested in the case and sought for a 5-day remand.
Additional Dhaka Metropolitan Magistrate Hasibul Haque granted the application for arrest and rejecting the remand plea, ordered for the interrogation at the jail gate for one day.
