HC asks for Nizam Hazari’s appeal, release documents

BSS, Dhaka :The High Court yesterday asked the authorities concerned to submit the documents relating to Nizam Hazari’s appeal and also the order for releasing him from jail. On hearing a petition, a bench comprising Justice Mirza Hussain Haider and Justice Khurshid Alam issued the order.The court also ordered the Inspector General of Prison (IGP) and senior jail super of Chittagong jail to submit an elaborate report by August 31 after examining the release order as well as the High Court decision upholding Hazari’s sentence awarded by the trial court. A Chittagong court on August 16, 2000 sentenced Nizam Hazari for 10 years under section 19(KA) and seven years under section 19 (Cha) of the arms act. The trial was staged in absentia. Harazi surrendered before the trial court on September 14, 2000 and he was sent to jail. The counsel of the writ petitioner Advocate Monzil Mursheed while submitting before the court said that according to a newspaper report Hazari was released from jail on December 1, 2005, which is inconsistent with the court verdict as he should have been in jail for 10 years. The court issued the rule on June 8 asking for an explanation from the authorities under what authority Nizam Uddin Hazari of Feni remains a member of Jatiya Sangsad (JS) even after his alleged forgery in getting early release from jail. Hazari was elected member of parliament (MP) as an Awami League candidate from Feni-2 constituency in the last general election. On hearing a writ petition, the bench issued the order along with a rule on the government asking for the explanation in four weeks why Feni-2, from which constituency Hazari was elected as an Awami League candidate, should not be declared vacated. Shakhawat Hussain Bhuiyan, a Jubo League leader of Feni, filed the writ petition bringing allegation that a Chittagong court on August 16, 2000 had awarded 10 years imprisonment to Hazari, but he served a lesser period through fraudulence. The court had also ordered the Inspector General of Prison and the Superintendent of Chittagong jail to submit a report before them in 30 days on the tenure of Nizam’s serving jail sentence in an arms case.Deputy Attorney General Al Amin Sarker yesterday submitted a report for the Chittagong jail authority. The report said Hazari was released from jail on bail on June 1, 2006 following an order of the court. The counsel for the petitioner submitted that according to Constitution, Nizami cannot be a candidate in the JS polls as he suppressed facts in his affidavit.
