The High Court on Tuesday stayed the government orders suspending Rajshahi City Corporation (RCC) Mayor Mosaddek Hossain Bulbul and Habiganj municipality Mayor GK Gaus.
Justice Syed Muhammad Dastagir Husain and Justice Md Ataur Rahman Khan passed the orders.
The court also issued a rule asking the authorities concerned to explain why the suspension orders of the RCC and Habiganj municipality mayors should not be declared illegal and unlawful.
Advocate Khandaker Mahbub Hossain and Advocate Aminul Haq Helal stood for the petitioners.
Aminul Haque said the HC issued another rule asking the government to explain why section 12 (1) of the Local Government (Union Parishad) Act, 2009 should not be declared contradictory to the constitution.
Earlier in the day, suspended Rajshahi City Corporation (RCC) Mayor Mosaddek Hossain Bulbul filed a writ petition with the High Court against the government’s suspension order.
The government on Sunday suspended the BNP-backed Mayor several hours after he took over, as the Supreme Court upheld a High Court order that declared his suspension illegal on March 5. On Sunday, the Ministry of Local Government, Rural Development and Cooperatives issued a circular suspending him again. Besides, Habiganj municipality mayor Gaus has been suspended again as he is an accused in a criminal case over killing of former Finance Minister Shah AMS Kibria.
Earlier on March 24, Gaus took charge of his office over three years after he had been suspended from the mayoral position. On December 30, 2015, Gaus was elected the Habiganj municipality mayor again for the third time contesting the polls from jail, but he could not join the office due to the suspension order. The High Court postponed the suspension order against Gaus on January 23 this year responding to a writ petition he filed and the Supreme Court also upheld the HC’s verdict in this regard on January 30.
Earlier on Monday, the High Court stayed the government order suspending Sylhet City Corporation Mayor Ariful Haque Chowdhury for the second time.
